Aelio is an informational planning aid — not an official FAA weather briefing. It does not satisfy your preflight-action obligations, and you must not rely on it as your sole source of weather or aeronautical information. Always obtain an official briefing and confirm conditions before every flight. As pilot-in-command, you are solely responsible for the safety and conduct of your flight.
These Terms of Service (the “Terms”) are a binding agreement between you (“you” or “user”) and JJC Air LLC (“Aelio,” “we,” “us,” or “our”) governing your access to and use of the Aelio mobile application, website, APIs, and related services (collectively, the “Service”). Please read them carefully. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
By creating an account, tapping “I understand” on an in-app notice, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. The Service is intended for use by pilots and others involved in flight planning who hold the appropriate knowledge and authority to make aeronautical decisions. The Service is not directed to children.
Aelio is an informational and educational flight-planning aid that aggregates publicly available weather and aeronautical data and presents summaries, visualizations, and suggested risk indicators (including go/no-go style decision labels) based on inputs you provide, such as your stated experience and personal minimums.
Aelio is not an official source of weather or aeronautical information, is not an FAA-approved or certified weather briefing or electronic flight bag (EFB), and is not a substitute for an official preflight weather briefing or for the preflight action and familiarization required of a pilot. Any decision label, score, or recommendation the Service displays is informational only and does not constitute aeronautical, operational, legal, or safety advice.
You must independently verify all information through official sources — including, in the United States, an official briefing via 1800wxbrief.com or an FAA-authorized provider — before each flight. The Service may be unavailable, delayed, incomplete, or inaccurate at any time.
Aviation is inherently dangerous. You understand and agree that:
The Service relies on data from third parties and public sources (for example, government weather services, aviation data providers, and flight-planning tools you choose to import from). We do not create, control, or independently verify this data and do not guarantee its accuracy, completeness, timeliness, or availability. Third-party data is subject to the terms and limitations of its providers. The Service may estimate, interpolate, or summarize data, and such derived content may contain errors.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Service for your own lawful flight-planning purposes. We reserve all rights not expressly granted.
You agree not to: (a) copy, modify, reverse engineer, decompile, or create derivative works of the Service except as permitted by law; (b) access the Service to build a competing product or to scrape, harvest, or resell data; (c) interfere with or disrupt the integrity, security, or performance of the Service; (d) use the Service in violation of any law or regulation, or for any commercial flight operation without ensuring independent compliance and verification; or (e) misrepresent your identity, experience, or authority.
If the Service offers accounts, you are responsible for the information you provide and for maintaining the confidentiality and security of any credentials. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. The personalization features of the Service depend on the accuracy of the information you provide; inaccurate inputs will produce unreliable output.
Some features may require a paid subscription or one-time purchase. Where purchases are made through the Apple App Store, payment, billing, auto-renewal, and refunds are handled by Apple under the Apple Media Services terms, and you should manage or cancel subscriptions through your Apple account settings. Prices and offerings may change prospectively. Except as required by law or by the applicable app-store policy, payments are non-refundable.
The Service, including its software, design, text, graphics, logos, and the “Aelio” name and marks, is owned by Aelio or its licensors and is protected by intellectual-property laws. These Terms do not transfer any ownership to you. Feedback you provide may be used by us without restriction or obligation to you.
If you obtained the app through the Apple App Store, the following applies and supplements these Terms:
The Service is provided “as is” and “as available,” with all faults and without warranty of any kind. To the maximum extent permitted by law, Aelio and its suppliers and licensors disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. Aelio does not warrant that the Service will be accurate, complete, reliable, current, uninterrupted, secure, or error-free, or that any decision label, forecast, or output will be correct or suitable for any flight or purpose.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
To the maximum extent permitted by law, in no event will Aelio or its officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or for personal injury, death, or property damage, arising out of or relating to your use of (or inability to use) the Service or reliance on any output, whether based in contract, tort (including negligence), strict liability, or any other theory, even if advised of the possibility of such damages.
In no event will Aelio’s total aggregate liability arising out of or relating to these Terms or the Service exceed the greater of (a) the amount you paid to Aelio for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) US $100.
These limitations are a fundamental basis of the bargain between you and Aelio. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above may not apply to you; in such cases our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Aelio and its officers, directors, employees, agents, suppliers, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or any law or regulation; (c) your reliance on any output of the Service; or (d) any flight or activity you conduct.
We may modify, suspend, or discontinue all or part of the Service at any time. We may also update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice (for example, in the app). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Where required, we may ask you to re-acknowledge an updated in-app disclaimer.
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including for any violation of these Terms. Upon termination, the licenses granted to you end, and the sections of these Terms that by their nature should survive (including Sections 3–5 and 12–18) will survive.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules, and, where applicable, by the U.S. Federal Arbitration Act.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at help@aelio.co and allowing at least 30 days to resolve it.
To the extent permitted by law, any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in Ocean County, New Jersey, rather than in court, except that either party may bring a claim in small-claims court. You and Aelio agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. You may opt out of arbitration by notifying us in writing within 30 days of first accepting these Terms.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Aelio regarding the Service and supersede prior agreements. Severability. If any provision is held unenforceable, the remaining provisions remain in effect. No waiver. Our failure to enforce a provision is not a waiver. Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices. We may provide notices through the Service or to the contact information associated with your account. Force majeure. We are not liable for delays or failures due to causes beyond our reasonable control.
